Its author (or the last surviving author in collaborative works) died more than seventy (70) years ago (Art. 29 & Art. 30).
Anonymous or pseudonymous work and seventy (70) years have elapsed since it was lawfully made available to the public (Art. 31, Par. 1).
Audiovisual work and seventy (70) years have elapsed since the death of the last survivor among the principal director, the screenplay author, the dialogue author, and the composer of music specifically created for the work (Art. 31, Par. 3).
Reproduction of a visual work already in the public domain, which does not meet the threshold of originality (Art. 31A).
Note: Moral rights are independent from economic rights (Art. 4, Par. 3) and are non-transferable between living persons (Art. 12, Par. 2). The author's name (paternity) must be mentioned if known.
